Article 1 (Application)

These Terms of Use (hereinafter "these Terms") establish the conditions for the use of the website operated by Japan EHS Audit Inc. (hereinafter "the Company") (hereinafter "this Website"). All users of this Website (hereinafter "Users") shall be deemed to have agreed to these Terms upon using the Website.

 

Article 2 (Prohibited Matters)

In using this Website, Users shall not engage in the following acts:

1.  Acts that violate laws or public order and morals.

2.  Acts related to criminal activity.

3.  Acts that destroy or interfere with the functions of the Company's servers or network.

4.  Acts that may interfere with the operation of the Company's services.

5.  Acts of collecting or accumulating personal information of other Users.

6.  Acts of unauthorized access or attempts thereof.

7.  Acts of impersonating other Users.

8.  Acts of providing benefits, directly or indirectly, to anti-social forces in connection with the Company's services.

9.  Acts that infringe on the intellectual property rights, likeness rights, privacy, honor, or other rights or interests of the Company, other Users, or third parties.

10. Any other acts deemed inappropriate by the Company.

 

Article 3 (Suspension of Provision of this Website, etc.)

1.  The Company may suspend or interrupt the provision of all or part of this Website without prior notice to Users if it determines that any of the following reasons exist:

    (1) When performing maintenance, inspection, or updates of the computer system for this Website.

    (2) When the provision of this Website becomes difficult due to force majeure such as an earthquake, lightning, fire, power outage, or natural disaster.

    (3) When computers or communication lines stop due to an accident.

    (4) In any other case where the Company deems it difficult to provide this Website.

2.  The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the provision of this Website.

 

Article 4 (Disclaimer of Warranties and Limitation of Liability)

1.  The Company does not warrant, either expressly or impliedly, that this Website is free from factual or legal defects (including, but not limited to, defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, as well as errors, bugs, or infringements of rights).

2.  The Company shall not be liable for any and all damages incurred by Users arising from this Website. However, this disclaimer shall not apply if the agreement between the Company and a User regarding this Website (including these Terms) constitutes a consumer contract as stipulated in the Consumer Contract Act.

3.  Even in the cases specified in the proviso of the preceding paragraph, the Company shall not be liable for damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of such damages) among damages incurred by the User due to default or tort caused by the Company's negligence (excluding gross negligence).

4.  The Company shall not be responsible for any transactions, communications, or disputes that may arise between a User and other Users or third parties in connection with this Website.

 

Article 5 (Changes to the Terms of Use)

The Company may, if it deems necessary, change these Terms at any time without notifying Users. If a User begins to use this Website after the changes to these Terms have been made, that User shall be deemed to have agreed to the modified Terms.

 

Article 6 (Governing Law and Jurisdiction)

1.  The interpretation of these Terms shall be governed by the laws of Japan.

2.  In the event of a dispute concerning this Website, the court having jurisdiction over the location of the Company's head office shall be the court of exclusive agreed jurisdiction.
